<br />Well, after the incident with <a href="http://www.joystiq.com/2009/09/15/lgj-come-as-your-avatar-smells-like-lawsuit-nevermind/">Courtney Love and Kurt</a>, it looks like the whole issue of famous musicians in games is back in the press with <a href="http://gamepolitics.com/2009/11/05/no-doubt-about-it-band-sues-activision">No Doubt suing Activision over <em>Band Hero</em></a>. A one time event is an anomaly, but twice in just a few months suggests something else. Of course, both of these all tie back to the contract, and since I'm a transactional attorney who spends the majority of most days negotiating and drafting agreements like these, I'm hoping I can shed a little light on what might be causing the problems. Since I wasn't involved in these particular negotiations nor have I read these contracts, all of what I'm presenting is speculation.<br /><br />But before I begin, I suppose I should answer the simple question, "What is a contract?" I assume that most people reading this have at least some idea, but just in case, it's worth describing in detail. A contract is a legally binding agreement between two parties to perform certain promises in the future. In theory, to form a contract there are five elements: Offer and acceptance, consideration, intent, capacity, and formalities. In reality, it's fairly simple. The parties must have a meeting of the minds, that is agree to the same terms, which is often viewed as an offer by one party and acceptance by the other. Each party must put up something of value, called consideration, for the contract to be valid. The parties must intend to enter into a contract, and be of the appropriate mental capacity to enter into the agreement. And then the agreement is generally recorded in writing, as most jurisdictions have rules that require written agreements, which is then signed by the parties. The dynamic duo from Penny Arcade have had long-standing animosity with infants, as evidenced by a <a href="http://www.penny-arcade.com/comic/2003/12/03/">number of</a> <a href="http://www.penny-arcade.com/comic/2004/5/7/">their past strips</a>. This cycle -- and the comic's victory streak -- continued in last week's Webcomic Wrapup winner, titled "<a href="http://www.penny-arcade.com/comic/2009/10/26/">Babicide</a>." Just to be clear, they're talking about demonic baby murder in this strip, and not that <a href="http://en.wikipedia.org/wiki/Barbicide">blue liquid that hairstylists use</a> to clean combs. <a href="http://www.joystiq.com/2009/10/12/review-demons-souls/">Perhaps you've heard</a>, but <a href="http://joystiq.com/tag/demons-souls"><em>Demon's Souls</em></a> is a hard game. Like <em>really </em>hard. Like bone-crushingly, soul-scathingly hard. Speaking to <a href="http://gameinformer.com/games/demons_souls/b/ps3/archive/2009/11/05/feature-demon-s-souls-director-discusses-difficulty-sequels-and-more.aspx">Game Informer</a>, <em>Demon's Souls</em> director Hidetaka Miyazaki explains why. According to Miyazaki, the difficulty was designed around giving players "a sense of accomplishment," specifically in regard to the soul collecting mechanic. For those who haven't played the game, souls act as currency and you lose <em>all</em> of them upon death. They can be regained, but only if you make it back to your bloodstain without dying twice more. Trust us, it's not as easy as it sounds.<br />

According to Miyazaki, "If the Souls could be recovered anytime, there would be no suspense or sense of accomplishment." He added that he wants players to feel like, "I did it! I made it to my bloodstain!" Of course, Miyazaki fails to mention the sense of utter, despairing failure one feels when they <em>don't</em> make it back to their bloodstain (a frequent occurrence).<br />

Regarding the possibility of a sequel, Miyazaki said he couldn't give a direct answer, but noted that the team learned a great deal on <em>Demon's Souls</em> and there were several things that didn't make it into the game. Given the opportunity, Miyazaki said he would "welcome the chance to create an even better game in the same style." To be considered for the prize, gamers must register for a free Sega Pass -- essentially the publisher's newsletter -- and enter for a chance to be selected on the <a href="http://www.sega.com/bayonettademo/">official <em>Bayonetta</em> demo site</a>.<br /><br />Registration for the "contest" will be open from Monday, November 9 to Friday, November 13. Winners will be notified on Monday, November 16. Those not selected will then be referred to as "the group least likely to win a 'boot-gun <em>thing</em>' firing contest" ... or PlayStation 3 players. Square Enix recently chose to attack with its annual earnings report, and among <a href="http://www.square-enix.com/eng/pdf/news/20091105_01en.pdf">the 12-page PDF file</a>'s barrage of numbers, things look pretty good for the company. Net sales for the six months ending September 30, 2009 were up 33 percent over the same period last year to 91 billion yen ($1 billion), while operating income was also up by 39 percent to 13 billion yen ($144.5 million) over the same period last year. It's not all roses and <a href="http://www.joystiq.com/2009/11/05/dragon-quest-ix-is-q3s-top-selling-game/"><em>Dragon Quest IX</em> sales</a>, however -- net income was down almost 58 percent to 2.7 billion yen ($30 million).<br /> <br /> The statement also talks about the <a href="http://www.joystiq.com/2009/02/12/square-enix-behind-eidos-takeover-bid/">acquisition</a> and <a href="http://www.joystiq.com/2009/04/27/eidos-stays-independent-following-square-enix-acquisition/">assimilation</a> of Eidos in direct proportion to Square Enix's games group division -- which includes video games across all platforms and online games for personal computers. Through the aid of titles like <em>Batman: Arkham Asylum</em>, <em>Kingdom Hearts 358/2 Days</em> and the aforementioned <em>Dragon Quest IX</em>, the games division rose its net sales and operating income by 117 percent and 63 percent to 4.8 billion yen ($53 million) and 1.0 billion yen ($11 million), respectively.<br /> <br /> As for the company's upcoming darling, <a href="http://www.joystiq.com/tag/final-fantasy-xiii"><em>Final Fantasy XIII</em></a>, Square Enix prez Yoichi Wada spoke about concern regarding the title's projected domestic sales. Basically, he's not concerned<em> at all</em>! "<span>PS3 sales continue to increase. We're <a href="http://www.joystiq.com/2009/09/24/sony-japan-unveils-250gb-final-fantasy-xiii-bundle/">bundling PS3 and <em>FFXIII</em></a>, and can expect even further sales increases. There are already too many quality titles taking up our time and this was supposed to be a "slow" year. How did our wallets ever keep up with holidays past? Oh wait, they couldn't. Alex Evans: The number of hand written fan letters from 4 year olds showcasing scribbly artwork they've re-imagined from your game.<br />

<strong>What's your favorite part of game development?<br />
</strong>Top'n'tail - the really fertile bit at the beginning, just messing around; and the final, final, tunnel of light where you actually ship the damn thing. The middle bit itself has phases: wherein you lost site of your initial good idea; realise what you've made sucks in several significant ways; rebuild it (several times); lose sight once more of the original idea; (hopefully) eventually recapture something of the original seed, by now actually usable; and finally enter the glorious 'tunnel of light' towards the end. The sellers were turned over to the store's loss prevention department.<br /> <br /> <em>That</em> bust led to one of the prospective buyers, named Christian Del Amo, who was raising money on a forum to buy the bundle (allegedly) for the purpose of copying the game and selling the copies, along with other pirated games, on hard drives. If you have ... well, your name is still on it. It's the complete series, filled with extras, and packaged to look like a nifty coffee table book, embossed with a copy of the misaligned badge logo from the opening of the show. Forget everything else, this is hands down one of the best cop shows ever created, and it captures the underbelly of Los Angeles perfectly. Some people would argue that Los Angeles is all underbelly. Hopefully that means there's plenty of Mackey to go around.<br /><br /></div>

When John Riccitiello needs to unwind from a long day as CEO of EA, he does it with dismemberment. <div align="left"><br />EA has announced a deal to feature the Strikeforce MMA league in its upcoming <em><a href="http://www.joystiq.com/tag/ea-sports-mma">EA Sports MMA</a>. </em>The publisher also finalized contracts with two pro mixed martial artists currently fighting in Strikeforce, Jake shields (pictured, left) and Brett Rogers, to appear on the game's roster. Don't expect the signings to throw any fuel on the <a href="http://www.joystiq.com/2009/07/13/ufc-president-confirms-war-with-ea-blacklisting-fighters/">UFC vs. EA</a> <a href="http://www.joystiq.com/2009/08/16/fox-fight-game-interviews-peter-moore-on-mma-war-with-ufc/">fire</a>, however, as neither fighter has ever been on the payroll of UFC prez Dana White.<br /><br />Frank Shamrock and Mauro Ranallo, Strikeforce's commentary team, will also be recording voiceover for the game. It has yet to be revealed which, if any other leagues will be featured in the game, and if their own commentary teams will be included. Currently, we know that MMA referee "Big John" McCarthy and Strikeforce ring announcer Jimmy Lennon, Jr. will also lend their voices and likenesses to the title.<br /><br />While locking up more <a href="http://www.joystiq.com/2009/07/29/ea-confirms-first-three-fighters-on-ea-sports-mma-roster/">pro talent</a> and the Strikeforce license lends credibility to <em>EA Sports MMA</em>, we've still yet to see any hint of an actual video game apart from a <a href="http://www.joystiq.com/2009/10/27/lock-your-eyes-on-first-ea-sports-mma-screenshot/">lone screenshot</a> released late last month. Hey, EA: You do know that, at this pace and given the nature of MMA, these guys could be retired by the time the game actually ships ... right?<br /> <em><br /></em></div>

Inspired by <em>Star Wars </em>characters like <a href="http://www.starwars.com/databank/character/grandmofftarkin/">Grand Moff Tarkin</a> and <a href="http://www.starwars.com/databank/character/zamwesell/">Zam Wesell</a>, the latest Not Jedi Knight class will be an expert with technology and espionage, using "abilities of subversion and subterfuge to infiltrate and assassinate enemies of the Sith Empire with deadly efficiency." <br />

Sounds like a good, assassin-style class for players whose friends inform them that not <em>everybody</em> can be a <a href="http://www.joystiq.com/2009/11/02/star-wars-the-old-republic-site-launches-jedi-class-page/">Jedi Knight</a> or a <a href="http://www.joystiq.com/2009/08/28/impressive-star-wars-the-old-republics-sith-warrior-class-det/">Sith Warrior</a>. The <a href="http://www.viddler.com/explore/Joystiq/videos/2364/">recently released English language trailer</a> for Square Enix and PopCap's RPG-puzzle mash-up <a href="http://www.joystiq.com/tag/gyromancer"><em>Gyromancer</em></a> has delivered a release date for our pending doom: November 18. Not only that, but the trailer's now-readable text has revealed a gameplay mechanic which slipped our attention in the original, Japanese trailer: <em>Monster collection</em>.<br />

So, it's <em>Bejeweled</em>, <em>Final Fantasy</em> and <em>Pok&eacute;mon</em> all rolled into one, then? Awesome. That's really awesome. The <a href="http://www.viddler.com/explore/Joystiq/videos/2358/">in-game trailer is pretty slick</a>, and features that super catchy We Are Scientists jam. (You know <a href="http://www.youtube.com/watch?v=rv2_LSIujHk">the one</a>, you <em>hip guy</em>, you.) However, <a href="http://www.viddler.com/explore/Joystiq/videos/2359/">the gameplay demonstration</a> actually shows the peripheral being used to go on a "sick run," apparently part of a long-standing feud between Activision and Robomodo.<br />

We decided to put the "sick run" at the top of the post, if only because we want you to know that this is <em>exactly</em> how we looked the first time <a href="http://www.joystiq.com/2009/06/05/hands-on-tony-hawk-ride/">we played the game at E3</a>. Only we didn't crash quite so much, and also, when we finished playing, Tony Hawk himself came up and gave us a high-five with one of his giant hands. A variety of new job listings have emerged on <a href="http://www.microsoft-entertainment-jobs.com/go/microsoft-games-studios-jobs/44366/">a Microsoft employment site</a>, including positions for <a href="http://www.joystiq.com/tag/project-natal">Project Natal</a> and -- perhaps more interesting -- positions for a new <em><a href="http://www.joystiq.com/tag/halo">Halo</a> </em>game. These listings for <em>Halo</em>, likely for <a href="http://www.joystiq.com/tag/halo-reach"><em>Halo: Reach</em></a>, call for designers, AI developers and animators -- even a multiplayer game design lead.<br />

As for Project Natal, some listings point to "a large franchise," whereas others quote "an excellent next-generation" project -- which could be just about anything. We confirmed with Microsoft's Larry "Major Nelson" Hryb that the listings were legit, though he couldn't provide us with any more info beyond that. <br />

It may look like a standard Netflix package, but inside PS3 owners will discover the "Instant Streaming Disc" which enables Netflix's instant streaming service on Sony's console.<br /> <br /> We've embedded a video overview of the service above. We'll admit that there are a few qualms with the presentation so far. First, the activation process is slow and requires the use of a computer -- there is no way to activate Netflix directly from the PS3. (You won't be able to use the PS3 internet browser for activation purposes either.) Second, the loading of cover art is suspiciously slow. Finally, there is no way to directly manage your Queue from the interface. While you'll be able to browse various categories, there is no Search capability. One benefit the PS3 has over the 360 in this regard is the built-in browser. You will be able to use the PS3's internet browser to manage your Queue. It's a baffling additional step, but it certainly is an added convenience. (<strong>ProTip</strong>: Use SELECT to add a bookmark to your PS3 internet browser.)<br /> <br /> While the <a href="http://www.joystiq.com/2009/11/06/first-footage-of-netflix-on-ps3/">previous video</a> we posted suggested otherwise, we can confirm that HD video works on PS3, and it works well. In fact, it's a bit faster than watching SD content, simply because you won't have to wait for the PS3 to switch between resolution modes. When browsing your queue, look for a tiny HD icon at the bottom of the screen to see if it will play in high-def. (The selection can be quite limited.) When judging the overall experience, however, we'd say starting movies required a longer buffer than when using the service on the 360 or PC. Considering the dichotomy of the moral decisions (see: good or evil) offered to the silent hero of the original <em>BioShock</em>, many have wondered how the upcoming undersea adventure, <a href="http://www.joystiq.com/tag/bioshock-2"><em>BioShock 2</em></a>, would take his actions in the first installment into account. Without a save game import feature (<a href="http://www.joystiq.com/2009/07/24/mass-effect-save-file-transfers-hundreds-of-decisions-to-seque/">ala <em>Mass Effect 2</em></a>), how could the sequel register the player's decisions in the original? The answer was recently revealed by <em>Bioshock 2</em>'s creative director, Jordan Thomas: <em>Ambiguity</em>, my dear Watson.<br />

<a href="http://multiplayerblog.mtv.com/2009/11/06/hero-of-bioshock-becomes-religious-figure-in-bioshock-2/">Speaking to MTV</a>, Thomas explained that, "the things that he did are being fiercely debated by the splicers, because we wanted to support any of the choices the player could have made in the first game." He later added, "It's become kind of a religious question; what he did at the end of <em>BioShock 1</em>." Golgoth recently dropped a press release to cut off conjecture about their next project at the pass, simply stating, "after our <em>Toki</em> remake release, we'll work on <em>Joe and Mac</em> license." That simple confirmation, as well as the concept art seen above, was really the only meat on the release's bones -- platforms for the remake, or a tentative launch window still remain unannounced.<br />

We'd love to toot our own horn for <a href="http://www.joystiq.com/2009/10/28/toki-remake-devs-planning-another-data-east-revival/">correctly guessing the franchise</a> Golgoth would work on next, but the studio's boss <em>did</em> say it would be a Data East-developed co-op platformer. The PS3 version of Platinum Games' action title sold 135,242 copies in its first week, topping the Media Create sales chart. The Xbox version had a good launch for an Xbox 360 game in Japan, at 64,325 copies. Most MMO players tend to spend significantly more time in their virtual environs than a 10-day free trial could possibly permit -- that's why Mythic Entertainment recently <a href="http://www.businesswire.com/portal/site/home/permalink/?ndmViewId=news_view&amp;newsId=20091106005173&amp;newsLang=en">made some drastic changes</a> to its trial program for <em><a href="http://www.joystiq.com/tag/warhammer-online">Warhammer Online: Age of Reckoning</a>. </em>From now on, folks who <a href="http://www.warhammeronline.com/trial/">demo the game for free</a> will have an unlimited amount of time to try it out -- however, their characters can only reach level 10 before they stop accumulating experience.<br />

Sounds like a wise move on Mythic's part to increase interest in the title, but we're worried that it might create a new breed of <em>Warhammer</em> trial players who get treated like second-class citizens by their subscription-paying counterparts. Screenshots of what may be a sequel to the <a href="http://www.joystiq.com/tag/XBLA/">XBLA</a> game <em> The Dishwasher: Dead Samurai</em> have landed on <a href="http://www.1up.com/do/newsStory?cId=3176792">1UP</a>, allegedly supplied by the same saboteur that leaked <a href="http://www.joystiq.com/2009/11/05/rumor-first-screens-details-for-halo-reach-leaked/">those supposed <em>Halo: Reach</em> images</a>. The shots certainly jive with the original game's art style and do feature some new enemies, backgrounds and objects. There are a number of new weapons shown, including a minigun, some kind of halberd, something that appears to be a giant syringe and -- our favorite -- a <em>humongous</em> pair of scissors.<br />

After the break, you can see (but not hear -- there's no sound in the recording) what the PS3 Netflix interface looks like. <br />

Unfortunately, the early report of the service doesn't sound quite <em>perfect</em>. Otis says in the YouTube description that all video renders at 480p and doesn't scale properly. We'll be testing these claims ourselves when we get the chance to check out the service. <div align="left">Former <em>X-Men</em>, <em>Battle Chasers</em> and <em>Ultimates </em>artist Joe Madueira and his team at Vigil Games are drawing closer to realizing the celebrated illustrator's dream of making his own video game, <span style="font-style: italic;">Darksiders</span>. We've seen the apocalyptic action-adventure a few times in the past, and its similarities to games such as the 3D <em>Zeldas</em>, <em>God of War</em> and, in some ways, <em>Devil May Cry </em>are still obvious in the latest build.<br /><br />There were some new elements for publisher THQ to show off, though, like War's range of attacks. <div style="text-align: left;">Namco Bandai has reported a net loss of &yen;6.04 billion ($66.7 million) for the first half of its fiscal year, which began in April. During the same period last year, the company posted a  net income of &yen;1.28 billion ($14.14 million). Despite this year's first-half hiccup, the publisher still expects to earn &yen;8.5 billion ($93.6 million) in net income by the end of its fiscal year (ending March 31, 2010). After all, there are those 2.5 million copies of <em>Tekken 6</em> <a href="http://www.joystiq.com/2009/10/31/namco-announces-2-5-million-shipped-copies-of-tekken-6/">waiting to be sold</a>.<br /> <br /> Namco Bandai's software sales for the period were led by the <em>Ben 10</em> franchise, as <em>Alien Force </em>and <em>Protector of the Earth</em> combined to sell approximately 810,000 units (not exactly <a href="http://www.joystiq.com/2009/11/05/guitar-hero-call-of-duty-franchises-lead-activisions-better-t/"><em>Guitar Hero</em> numbers</a>, eh?). Even with <em>Tekken 6 </em>in its second-half roster, Namco must be pulling for a miracle. The beta features one match type -- Rush, a version of <span style="font-style: italic;">Bad Company's </span>Gold Rush ... only without the gold -- and takes place in the sun-baked seaside locale of Arica Harbor.<br /><br />Last week, we took part in a 24-player stress test for the beta (the version coming Nov. 19 will support 24 players, as will the final game) and came away rattled but ready for more. In fact, she travels with you the whole time ... in spirit! <br /> <br /> In one of the craziest <em>Zelda</em> trailers we've ever seen, some wizard shows up and turns Zelda into a ghost, and then she sort of mopes around as an apparition until some guy with wheels suggests that she go on a road trip with Link. The clip is mock "surveillance video" of two naked men desperately barging into a Chinese restaurant. The streakers are apparently on the run -- there's some gun fire aimed in their direction -- until one (possibly Lynch by the looks of his hairstyle) trips and falls over a table, only to be attacked a few seconds later by a dog. The new element allows players to tackle challenges and compete against other teams online for popularity within the Skate.Feed community. PC retailers, starting with IGN's Direct2Drive download service, have made the bold move to leave piles of money on the table by refusing to <em>sell</em> it. It's not in protest of the <a href="http://www.joystiq.com/2009/10/18/modern-warfare-2-pc-wont-support-dedicated-servers/">dedicated server issue</a> or the <a href="http://www.joystiq.com/2009/11/05/modern-warfare-2-limited-to-9-vs-9-on-pc/">multiplayer cap</a>, but rather the fact that the game relies on <a href="http://www.joystiq.com/2009/10/23/pc-modern-warfare-2-gets-steamworks-steam-cloud-steam-achievem/">Steamworks</a> for updates, saving and Achievements; and Direct2Drive isn't thrilled about selling a game that requires the bundling of a competitor's product.<br /> <br /> "At Direct2Drive," the statement on what <em>would</em> be the <em>Modern Warfare 2</em> <a href="http://www.direct2drive.com/2/8687/product/Buy-Call-of-Duty:-Modern-Warfare-2-Download">product page</a> reads, "we believe strongly that when you buy a game from us, you shouldn't be forced to install and run a 3rd party software client to be able to play the game you purchased." The site offers an Amazon link to purchase the game, and a $5 coupon for <em>other</em> Activision titles on Direct2Drive.<br /> <br /> Impulse and GamersGate won't be offering the <em>Modern Warfare 2</em> either. Three PSP titles appear on the PSN bestsellers list for October. It makes sense, considering the launch of the all-digital <a href="http://www.joystiq.com/tag/psp-go">PSP Go</a>. Surprisingly, the much-anticipated <a href="http://www.joystiq.com/tag/gran-turismo-psp"><em>Gran Turismo PSP</em></a> didn't top the charts. Instead, PSone classic <em>Final Fantasy VII</em> took the lead <a href="http://playstation.joystiq.com/2009/07/02/final-fantasy-street-fighter-and-castlevania-top-the-psone-sale/">once again</a>, undoubtedly boosted by nostalgic RPG players wanting to relive Cloud Strife's cross-dressing adventure <em>on the Go</em>. Among twelve finalists, the Game Boy joins the Big Wheel and the ball to be added to the list of important cultural toys.<br />

Yes, the ball is just <em>now</em> being inducted into the hall of fame, meaning Nintendo's handheld made the cut in two decades, while the ball had been clawing for a spot since the days of <a href="http://en.wikipedia.org/wiki/Ball">Ancient Egypt</a>. Alyse isn't just your usual <em><a href="http://www.joystiq.com/tag/legend-of-zelda">Legend of Zelda</a> </em>fan -- aside from the drawer full of Link-themed clothing and decorative <a href="http://www.joystiq.com/tag/majoras-mask"><em>Majora's Mask</em></a> cup set sitting in her cupboard, she's now also the proud owner of the gigantic Lego mosaic you see above. The product of her brow's sweat and her hand's work, the mosaic was created for <a href="http://www.brickcon.org/">Brickcon</a>, an annual event that celebrates adult Lego hobbyists. <br />

This isn't a trailer or developer diary -- you're in for nine minutes of unedited, uninterrupted gameplay footage from the most recent build of <em>ME2</em>. In fact, it's the same mission -- set inside Omega's "Inferno" nightclub -- that we ourselves <a href="http://www.joystiq.com/2009/11/06/hands-on-mass-effect-2/">got to play</a> earlier this week. (And yes, we can confirm it looks <em>that good</em>.)<br /><br />You'll get a sense of the sequel's leap in environmental detail, character modeling and dialog scene camerawork in this clip, along with <em>loads </em>of intense combat. There's even an appearance by returning character (and total badass) Garrus from the first <em>Mass Effect, </em>plus a joke that manages to poke fun at rumors of <a href="http://www.joystiq.com/2009/05/02/commander-shepard-probably-isnt-dead-in-mass-effect-2/">Commander Shepard's death</a> <em>and </em>the fact players can make him/her look like anyone they choose.
